My husband was involved in a head on collision that totaled our vehicle. He had no injuries thanks to his air bag. He was talking on his hands free device that ran through his navigation unit in the car at the time of the accident. We live in CA where it is legal to talk on a hands free device. The other driver ran a red light and there was a witness that had been stopped in the lane next to him at the red light when he ran through it. Could my husband be deemed at fault at all if he was on a hands free device? Thank you for any information you can provide.
